You might think after being in the spotlight for foreclosure fraud and Robo-Signing since last fall that the country’s major Banks and Lenders would stop their illegal practices, but they haven’t. Even after they vowed this past March to stop their illegal foreclosure practices, some of the largest Banks, including OneWest, Bank of America, HSBC Bank USA, Wells Fargo and GMAC Mortgage, have produced questionable foreclosure documents nationwide.

In recent months, Reuters has found nearly ten “robo-signers” who have further perpetrated foreclosure fraud for the major Banks. Each of them have signed thousands of foreclosure and mortgage documents regarding ownership of a home and provide evidence in court for who has the legal right to foreclose. Mind you, these are the same people who in court have admitted to signing documents that they have never seen or known the details of. Judges nationwide have taken notice, many of whom have openly called out the foreclosure fraud and questionable activities of robo-signing employees. In a recent New York case with HSBC, a judge called out the “robo-signer” Christina Carter and went so far as to threaten HSBC’s chief executive officer with sanctions for the illegal actions.

Asteroid nears earth

An asteroid measuring between 15-60 feet in diameter will pass within approx 7,600 miles of earths atmosphere at 1pm EDT.

Astronomers are saying there is no chance of it colliding with earth. Lucky really as an asteroid of that size would have an impact similar to 2 or 3 atom bombs, experts say.

The astrroid named 2011MD should ve bright enough to be seen with a telescope.

This is not he first instance of a “near miss” a small astrroid earlier this year passed within 3,500 miles of Earth.

This illegal process is in violation of the foreclosure process in California, this process is somewhat consistent with other non judicial states throughout the country. Knowing the foreclosure process in California and your home state is important to keeping your home and making sure that no one steals what is rightfully yours.

The great thing for homeowners facing foreclosure is that this goes beyond whether payments were made on time. This if foreclosure fraud, and the foreclosure process in your state is established to protect the rights of homeowners; provided homeowners follow their states nonjudicial foreclosure process, beginning with an objection on all points.


The foreclosure Process In California

If the mortgage debt is not cured after approximately four (4) months, the next step in the foreclosure process in California is a Notice of Trustee’s Sale. This notice is also recorded at the local county courthouse, in the local newspaper, and mailed to the homeowner within 30 days of the Notice of Default. A copy of the Notice of Trustee’s Sale must also be posted at the physical property address and the homeowner must receive at least 20 days notice prior to the actual date of the foreclosure sale. The date of the Trustee’s Sale must be set at least 21 days after the date which the Notice of Sale is recorded and published in the local newspapers. There are several methods to postpone a foreclosure sale. Filing a court injunction to stop the foreclosure due to foreclosure fraud is option when you have all of your documents together and can prove that the Pretender Lender violated the foreclosure process and your due process rights. Some homeowners also seek other alternatives such as filing bankruptcy, selling the home in a short sale or attempting a deed in lieu of foreclosure. Californians can file a stop foreclosure now sale up to five (5) days in before the sale date.

At the Trustee’s Sale, the highest bidder becomes the new legal owner of the property. In the cases where there are no bidders on the property, it becomes bank (REO) owned.
