Foreclosure fraud is quickly becoming an issue that countless American homeowners, including military servicemembers, are faced with today. “It’s great to see that military personnel are starting to take advantage of the government programs and additional foreclosure help that is available to them,” echoed Rick Haughton. “Too frequently American homeowners, including military servicemembers, do not seek foreclosure help and assistance due to lack of information. Many feel paralyzed by their situation and as a result, fail to take action. Luckily for military servicemembers they have additional resources and programs available to them to delay foreclosure while a plan to stop foreclosure fraud entirely is crafted.”
“With military personnel, it’s a lot more black and white when it comes to foreclosure fraud. They have additional laws and provisions that protect them such as the Servicemembers Civil Relief Act (SCRA) and the newly expanded Military Homeowners Assistance Program (HAP), where military personnel can receive more foreclosure help and assistance than ever before,” Haughton elaborates. “A portion of the government stimulus program passed in 2009 by President Obama, the American Recovery and Reinvestment Act, allocated over $555 million dollars to the HAP program. The additional funds provide military servicemembers with foreclosure help, assistance with rent, and other forms of financial aid.”
“The first thing military servicemembers should do if in need foreclosure help is determine what stage they are at. Are you behind a few months? Have you received a notice of default on your mortgage? Or have foreclosure proceedings already been brought against you” Haughton explains. “It’s important to know your starting point, and determine what type of program or assistance will help you moving forward. “If a servicemember is already amidst foreclosure proceedings the plan would be to examine the SCRA, which can aid in up to a year of foreclosure stoppage” stated Haughton. Very frequently pretender lenders don’t pay attention to whether or not a person’s home is owned by military personnel or not. As a military servicemember you have additional protections available to you to help you protect your home against foreclosure fraud.
“The reality is that pretender lenders don’t possess the necessary documentation to foreclose. Civil rights of servicemembers and American homeowners are invalidated everyday because most just assume that to not pay a debt makes them at fault, which is not the case.
